Mommy Wine Marketing Sets Off Winery Feud

Is there room for more than one wine for overworked moms? Not if one winery's lawsuit has anything to do with it

The best wine brings people together over dinner and laughter, but sometimes things go awry. This is one such time, but it doesn’t have anything to do with acting out after one wine glass too many. Rather, this story involves two wineries who are waging a war of words, according to a lawsuit filed last week. The offending word in question: “mommy.”

Clos La Chance is a small production winery based In Central California just south of San Jose. Cheryl Durzy, mother of two and marketing manager for Clos LaChance, has recently launched MommyJuice, a spin-off of the winery marketed specifically to moms in need of a night off. “Being a Mom is a constant juggling act,” reads the wine’s website. “Moms everywhere deserve a break. So tuck your kids into bed, sit down and have a glass of MommyJuice—because you deserve it!”

It’s a clever way to market the wine, but one company is taking umbrage – Selective Wine Estates Inc, a New Jersey based wine distributor that lists among its wares an Italian wine called Mommy’s Time Out.

Clos La Chance Wines filed a lawsuit last week asking the San Francisco federal court to declare that its MommyJuice wine does not improperly infringe on the trademark of Mommy’s Time Out. “Mommy is a generic word that they don't have a monopoly on," a legal representative of Clos La Chance told Reuters.

Both wine brands offer a red and white wine variation, though one is imported from Italy while the other comes from a California winery. With similar taglines – “YOU DESERVE A TIME OUT FOR YOURSELF” reads the website for Mommy’s Time Out – each winery is clearly after the same mommy demographic. But it’s now up to the San Francisco court system to decide whether the two are too similar to coexist.
